properties, tools, and services provided by Omelo, a platform owned and operated
by Pawtech Solutions Private Limited (“Omelo”, “we”, “us”, or “our”). These
include our website www.beomelo.com, our mobile application (the “App”), our
AI-powered diagnostic systems, 24/7 vet triage features, and any other interfaces,
features, or tools we make available via WhatsApp, Android, iOS, or future
platforms (collectively referred to as the “Services”).
In these Terms, the words “you” and “your” refer to:
(a) you as the individual user,
(b) your legal dependents or animals under your care (including dogs, cats, cattle,
goats, or other animals),
(c) any person you are using the Services on behalf of (as permitted under Section
10), and
(d) your successors, assigns, legal representatives, and heirs.
By accessing or using our Services, you confirm that:
● You are at least 18 years old or are using the platform under the supervision
of a parent, guardian, or veterinarian.

● You agree to these Terms and to Omelo’s Privacy Policy.

● If you are using the Services on behalf of someone else (such as a pet
parent, livestock owner, or animal welfare provider), you have the authority
to act on their behalf, and your acceptance of these Terms is binding on them.

If you do not agree to these Terms or our Privacy Policy, please do not use the
Site, the App, or any of Omelo’s Services.
Omelo is designed to operate as a guardian assistant—not a substitute for licensed
veterinary medical care. While we use AI to guide, triage, and educate, our
platform does not replace professional medical advice, diagnosis, or treatment. You
are solely responsible for your reliance on any information provided by Omelo’s
AI systems or vet triage services. When in doubt, always consult a licensed
veterinarian.

Privacy and Use of Your Information
By using Omelo’s Services, you agree and consent to the collection, storage,
processing, and use of your data—including text, images, videos, audio, and
diagnostic inputs—under the guidelines outlined in the Omelo Privacy Policy.
We are deeply committed to protecting your trust. Your personal information, pet
health history, veterinary interactions, and AI companion conversations may be
securely stored and used:
● To personalize your experience

● To enhance diagnostic accuracy

● To improve the performance of our AI systems

● To provide better vet care coordination

● To develop new features and functionalities for pet parents and livestock
owners across India

Omelo follows Indian data protection laws and globally accepted ethical standards.
We never sell your information, and we only share it when absolutely necessary for
delivering our Services or if required by law.

Services Provided – No Veterinary Advice from Omelo
Omelo is built on the belief that AI-powered guardians can empower millions of
pet and animal caregivers with instant, intelligent, and empathetic
support—anytime, anywhere. Our AI Companion is trained to understand, guide,
and triage symptoms based on global veterinary best practices, real-time inputs,
and structured animal health protocols.
However, you must understand and agree to the following:
● Omelo does not offer licensed veterinary advice or treatment.
The information, conversations, disease scans, or triage recommendations
from Omelo’s systems are for educational and preventive purposes only.
They are designed to support—not replace—clinical judgment by a qualified
vet.

● You are solely responsible for how you act on the information received.
Always consult a licensed veterinarian before making medical decisions,
starting or stopping treatments, or acting on any AI-generated
recommendation—especially in cases of injury, visible symptoms, distress,

or suspected emergencies.

● AI is always learning—but not always perfect.
As a user, you acknowledge that Omelo is built on conversational AI that is
continually improving. While our models are trained on a broad base of
animal healthcare data, mistakes may still occur. Do not rely on Omelo for
time-sensitive, emergency, or high-stakes decisions without human
verification.

● Data from conversations and diagnostic flows may be used to improve
the service.
We use de-identified logs and metadata to improve the intelligence, safety,
and empathy of our Companion. This helps us build smarter, more
responsive tools over time. Your data makes Omelo better—for everyone.

● You must use Omelo responsibly and ethically.
Your access to Omelo is subject to compliance with our Acceptable Use
Policy (see Section 6). Misuse, abuse, or exploitation of the AI system may
result in suspension or termination of access.

In short:
Omelo is your 24/7 pet guardian—not a vet. We support, empower, guide, and
triage—but we do not diagnose, treat, or prescribe. Your vet is your ultimate
medical authority.

Registering for Omelo’s Services
To access Omelo’s AI Companion, Disease Scan, or Vet Support features via the
mobile app, website, or WhatsApp, you are required to register using your name,
mobile number, and optionally, email.

By registering, you agree to the following:
● Provide accurate and complete information.
You may only register using your own valid mobile number and personal
details. Impersonation, fake identities, or unauthorized access using another
person’s information is strictly prohibited.

● Authorized representatives only.
If you are registering on behalf of a family member, livestock caretaker,
veterinary clinic, or an organization, you warrant that you have full authority
to accept these terms on their behalf.

● Protect your account.
You are solely responsible for all activity that occurs under your Omelo
account. It is your duty to secure your phone, device, OTPs, and login
credentials. Omelo is not liable for losses arising from unauthorized access
due to user negligence.

● Age restrictions apply.
Omelo is currently intended for users aged 18 years and above. If you are
a minor, please do not attempt to use or register for Omelo. If we become
aware of any minor using our Services, we will revoke access and delete all
associated data in compliance with privacy protocols.

If you believe a minor is using Omelo, please write to us at hello@beomelo.com
and we will take swift corrective action.

Acceptable Use Policy

Omelo exists to provide safe, ethical, and intelligent support to pet and livestock
owners across India. To ensure responsible use and protect our ecosystem, you
agree to follow these usage rules:
Illegal Use
You must not use Omelo for any unlawful activity. This includes violating Indian
laws or misusing Omelo’s features in a manner not intended or permitted.
Harmful Use
You may not use Omelo to create or distribute content that:
● Promotes self-harm, violence, or abuse toward animals or humans

● Encourages unethical veterinary practices

● Intentionally spreads medical misinformation

● Mimics or impersonates certified veterinary professionals
Abusive Content
Do not use Omelo to generate or share:
● Sexually explicit, violent, or discriminatory content

● Hateful, casteist, or communal language

● Shock-inducing or trauma-triggering materials
Such content is strictly prohibited and may lead to immediate account
suspension or legal action

Infringing Rights

You must not use Omelo to violate others’ rights, such as:
● Accessing or sharing private data without consent

● Attempting to identify, track, or expose any individual’s personal details

● Uploading unauthorized images, audio, or health reports
System Tampering & Reverse Engineering
You may not:
● Attempt to extract, reverse-engineer, or replicate Omelo’s AI, disease scan
models, or triage logic

● Bypass safety systems, content filters, or moderation safeguards

● Create a competing system using data, prompts, or outputs derived from
Omelo
Automated Scraping & Unauthorized Access
Manual or automated scraping, crawling, or indexing of Omelo’s interfaces, APIs,
or content—including disease prediction models or chat data—is strictly
prohibited.
Violations of this policy may result in:
● Temporary or permanent suspension

● Legal notice under Indian cyber law

● Reporting to authorities for any criminal misuse

Services Provided — No Medical Advice by Omelo
Omelo is an AI-powered preventive healthcare platform for pets and livestock. It
provides real-time diagnostic guidance, behavioral interpretation, and instant AI
companion conversations—but it is not a substitute for licensed veterinary care.
You understand and agree:
● Omelo does not offer medical advice.
The information and suggestions you receive through Omelo—whether via
the Companion, Disease Scan, or automated health prompts—are for
informational and educational purposes only. They are not to be treated
as a confirmed diagnosis or treatment plan.

● You are solely responsible for your actions.
Decisions made based on Omelo’s responses, scans, or content are taken at
your own discretion. We recommend that any serious or emergency situation
be addressed by a certified veterinarian immediately.

● Continuous learning, not perfect advice.
Omelo is built on advanced AI models that evolve based on interaction
patterns, regional conditions, and behavioral signals. While every effort is
made to ensure accuracy, the system may occasionally provide incomplete
or inaccurate outputs due to the probabilistic nature of conversational AI.

● You allow us to improve using your anonymized data.
Your interactions may be used to improve Omelo’s health logic, disease
detection, and vet triage accuracy. We may also use metadata like
timestamps, interaction patterns, or scan feedback to enhance safety and
personalize your experience—only in accordance with our Privacy Policy.

Product Overview — Omelo Companion & Disease Scan
Omelo currently offers the following core services via its mobile app and
WhatsApp interface:
Omelo Companion
Your real-time, AI-powered, emotionally intelligent chat assistant. Built for
multilingual, trust-building conversations that help decode symptoms, guide you to
right actions, and escalate to vet support if needed.
● Not a vet. Not a chatbot.
The Omelo Companion is designed to simulate empathetic, informative,
and behaviorally aware discussions. It can suggest common patterns, flag
emergencies, and calm anxious pet parents—but does not replace certified
medical care.
Omelo Disease Scan
Upload a photo of your pet’s affected area (skin, eye, vomit, stool, etc.) and get a
diagnostic pattern match based on AI-trained datasets. This tool helps in early
detection of visual symptoms and suggests next steps.
● Scan results are probabilistic.
You must always confirm findings with a certified vet—especially if
symptoms persist or worsen.

Not for Emergencies
Omelo is not an emergency or 24/7 crisis response platform.

If your pet or livestock is:
● Bleeding profusely

● Vomiting uncontrollably

● Suffering seizures

● Choking or unconscious

● Struggling to breathe

● Or showing signs of extreme distress

Call your nearest vet or animal hospital immediately.
Do not delay treatment while waiting for Omelo’s outputs or AI conversation
results. Always prioritize in-person medical intervention in emergencies.

Risks Associated with Telehealth and AI-based Advice
Omelo offers a digital interface to connect you with verified veterinary
professionals (when available), and an AI layer that gives preventive suggestions.
By using this system, you acknowledge:
● AI models are probabilistic, not diagnostic.
Omelo’s disease scan or companion may misinterpret certain rare or
complex cases.

● Internet/Camera quality can affect results.
Low image resolution, improper lighting, or unclear symptom description

may reduce accuracy of scan interpretation or chatbot logic.

● No access to full medical history.
Omelo does not have access to prior test records unless uploaded by the
user. Hence, all insights are based only on current input context.

● Digital isn’t always enough.
Complex, chronic, or escalating conditions must always be escalated to
human veterinary professionals—even if Omelo’s Companion seems to give
a confident reply.

No Endorsements
Omelo does not endorse any specific healthcare provider, medication, pharmacy, or
pharmacologic product. If you use and rely on third parties you learn about through
Beyond, you do so solely at your own risk.

Not an Insurance Product
Omelo is not an insurer and does not otherwise provide insurance services or
products. If you desire any type of health insurance or other insurance, you will
need to purchase such insurance separately.

Availability of Services
Omelo’s Services are currently intended solely for users residing within India. By
accessing or using any part of the Omelo Site, App, or Products, you represent and
warrant that you are not located in a jurisdiction where use of these Services is
prohibited by local laws. If you attempt to access Omelo from a jurisdiction where
the Services are not legally offered, your access will be restricted or may be

terminated without notice. We explicitly prohibit use of Omelo’s Services in
regions or countries where their content, access, or functionality is illegal or not
compliant with local regulations.
You further acknowledge and agree that Omelo may not be able to deliver products
or services to certain pin codes due to regulatory, logistical, veterinary, or other
operational limitations. If you have placed an order from such a region, we reserve
the right to cancel the order and process a refund where applicable.

Ordering and Purchasing of Products
Order Acceptance and Shipment
Placing an order with Omelo—whether through the App, Site, or any direct
channel like WhatsApp—does not guarantee order acceptance. Orders will be
accepted only after Omelo has received all required information, validated your
payment method, and determined feasibility of fulfillment. We may request further
verification or data before processing your order.
If we cannot fulfill your order within 30 days, we will notify you and cancel the
order, initiating a full refund where payment has already been made. Omelo does
not support or authorize resellers, distributors, or bulk purchasers with resale
intent.

Typographical Errors and Pricing Accuracy
Omelo strives for accuracy in product information and pricing. However, in the
event of typographical or pricing errors—either displayed on our platform or
received from third-party providers—we reserve the right to cancel or refuse such
orders, even if payment has been processed. In such cases, a full refund will be
initiated promptly.

Risk of Loss

All Omelo products are shipped via certified third-party logistics partners. Once
the product is handed over to the shipment carrier, the risk of loss transfers to you.
Omelo is not responsible for delays or damages caused during transit by the carrier.

Return Policy
Returns are accepted in accordance with Omelo’s Return & Refund Policy
available on our website. Only unopened and unused products in their original
packaging may be considered eligible for return. Health diagnostic products may
have stricter return conditions due to safety and compliance protocols.

Online Payments
Omelo supports digital payments through credit/debit cards issued by Indian
financial institutions, UPI, and approved wallet platforms. In using these services,
you affirm:
● The information you provide is accurate and legally yours.

● You authorize Omelo to process the payment and, if needed, obtain
pre-authorization up to the payment amount.

● You will bear all fees, taxes, and surcharges applicable to your transaction.

● You are solely responsible for ensuring your payment details remain current.

Any delays or service disruptions caused by outdated or invalid payment
credentials will be your responsibility.

Eligibility; Account Access, Security, and Restrictions

14.1 User Eligibility & Registration
By creating an account on Omelo, you represent that:
● You are at least 14 years of age.

● You are legally capable of entering into a binding contract.

● All information you provide is truthful, accurate, and kept up to date.

If registering on behalf of another person or pet (e.g., your dependent or animal),
you confirm that you are authorized to act in that capacity. You are responsible for
the confidentiality of your login credentials and agree not to share or delegate
access to your account.

14.2 Account Security
You accept full responsibility for any activity conducted through your account,
whether or not authorized by you. Omelo reserves the right to suspend or terminate
access if we suspect misuse, security breaches, or fraud. You agree to notify Omelo
immediately at hello@beomelo.com if your account is compromised.

Restrictions on Minors
Except where explicitly allowed under supervision of a parent or legal guardian,
Omelo Services are not intended for individuals under the age of 14. Omelo does
not knowingly collect personal data from minors. If you believe a minor is using
the platform without consent, please notify us immediately for prompt action,
including data removal and access revocation.

Proprietary Rights & Intellectual Property

All content, designs, algorithms, copy, medical flows, AI conversational elements,
and other intellectual property related to Omelo are owned by or licensed to
Pawtech Solutions Private Limited. You agree not to reproduce, distribute,
republish, frame, or exploit any part of Omelo's systems, branding, models, or
materials for commercial or unauthorized purposes.
You are granted a limited, revocable, non-transferable license to access and use
Omelo Services solely for personal, non-commercial use. Any unauthorized
usage—including attempts to reverse engineer our AI models, scrape app data, or
copy diagnostic logic—will be considered a breach of these terms and may lead to
immediate legal action.

Links to Other Sites
Omelo makes no representations whatsoever about any other website that you may
access through the Services. When you access a non-Omelo site, please understand
that it is independent from Omelo, and that Omelo has no control over the content
on that website. In addition, a link to a non-Omelo website from the Site / App
does not mean that Omelo endorses or accepts any responsibility for the content, or
the use, of the linked site. It is up to you to take precautions to ensure that whatever
you select for your use or download is free of such items as viruses, worms, Trojan
horses, and other items of a destructive nature. If you decide to access any of the
third-party sites linked to or otherwise referenced in our Site / App, you do so
entirely at your own risk.

User Information
If you submit, upload, post or transmit any pet health information, medical history,
veterinary conditions, symptoms, personal information, consent forms, agreements,
requests, comments, ideas, suggestions, information, files, videos, images or other
materials to us or our Site (“User Information”), you agree not to provide any User

(1) is false, inaccurate, defamatory, abusive, libelous, unlawful, obscene,
threatening, harassing, fraudulent, pornographic, or harmful, or that could
encourage criminal or unethical behavior,
(2) violates or infringes the privacy, copyright, trademark, trade dress, trade
secrets or intellectual property rights of any person or entity, or
(3) contains or transmits a virus or any other harmful component.
If you submit User Information about a Minor or a pet owned by someone else,
you represent and warrant that:
(i) you have the right to submit such information to Omelo, and
(ii) you will indemnify Omelo against any claims arising from your violation of
the rights of such individual or pet.
In addition, you agree not to contact other site users through unsolicited e-mail,
telephone calls, mailings, or any other method of communication.
You represent and warrant to Omelo that you have the legal right and authorization
to provide all User Information to us for use as set forth herein and required by us.
Omelo may:
(i) de-identify your information such that it is no longer considered protected
health information or personally identifiable information, and
(ii) disclose, aggregate, sell, or otherwise use such de-identified information to
third parties for analytics, research, or other purposes. Please refer to the Omelo
Privacy Policy for more information.
You agree not to:
(i) access or use the Services in any unlawful way or for any unlawful purpose;
(ii) post or transmit (a) a message under a false name, or (b) any data, materials,
content, or information (including, without limitation, advice, and
recommendations) (collectively “Information”) which is (1) libelous, defamatory,

obscene, fraudulent, false, or contrary to the ownership or intellectual property
rights of any other person, or (2) contains or promotes any virus, worm, Trojan
horse, time bomb, malware, or other computer programming or code that is
designed or intended to damage, destroy, intercept, download, interfere,
manipulate, or otherwise interrupt or expropriate the Site / App, personal
information, software, equipment, servers, or Information or facilitate or promote
hacking or similar conduct;
(iii) impersonate or misrepresent your identity or falsely state or misrepresent your
affiliation with a person or entity;
(iv) tamper, hack, spoof, copy, modify, or otherwise corrupt the administration,
security, or proper function of the Site / App;
(v) use robots or scripts in connection with the Site / App;
(vi) attempt to reverse engineer, reverse assemble, reverse compile, decompile,
disassemble, translate, or otherwise alter, defraud, or create false results from any
executable code, information on, or received by the Site / App;
(vii) use antivirus or antispyware software set to override the internet browser’s
cookie settings;
(viii) incorrectly identify the sender of any message transmitted to Omelo. You
may not alter the attribution or origin of electronic mail, messages, or postings;
(ix) harvest or collect health information about any other individual or pet who
uses the Services;
(x) infringe or facilitate infringement on any copyright, patent, trademark, trade
secret, or other proprietary, publicity, or privacy rights of any party, including such
rights of third parties.
You agree to defend, indemnify, and hold harmless Omelo and its affiliates from
and against all third-party claims, damages, and expenses (including reasonable
attorneys’ fees) arising out of any User Information you upload to or transmit
through the Services.

Claims of Copyright Infringement
We disclaim any responsibility or liability for copyrighted materials posted on the
Site / App. If you believe that your work has been copied in a manner that
constitutes copyright infringement, please follow the procedures set forth below.
omelo respects the intellectual property rights of others and expects its users to do
the same. In accordance with the Digital Millennium Copyright Act ("DMCA"),
we will respond promptly to notices of alleged infringement that are reported to
Omelo’s Designated Copyright Agent, identified below.
Notices of Alleged Infringement for Content Made Available on the Site
If you are a copyright owner, authorized to act on behalf of one, or authorized to
act under any exclusive right under copyright, please report alleged copyright
infringement staking place on or through our Site by sending us a notice ("Notice")
complying with the following requirements.

Identify the material or link you claim is infringing (or the subject of infringing
activity) and that access to which is to be disabled, including at a minimum, if

applicable, retain all right, title, and interest in and to the Services and any
information, products, documentation, software, or other materials on the Site /
App and the packaging of the Omelo products, and any patent, copyright, trade
secret, trademark, service mark, or other intellectual property, or proprietary right
in any of the foregoing, except for information on the Services licensed by Omelo
(in that case, the license provider retains all right, title, and interest therein). The
information available through the Site / App is the property of omelo or its
licensors, as applicable. You agree not to store, copy, modify, reproduce,
retransmit, distribute, disseminate, rent, lease, loan, sell, publish, broadcast,
display, or circulate such information to anyone. Use, reproduction, copying, or
redistribution of omelo trademarks, service marks, and logos are strictly prohibited
without the prior written permission of omelo, as applicable. The immediately
foregoing sentence also applies to any third party trademarks, service marks, and
logos posted on the Site and/or App. Nothing contained on the Site and/or App
should be construed as granting, by implication, estoppel, waiver or otherwise, any
license or right to use any trademarks, service marks, or logos displayed on the Site
and/or App without the written grant thereof by Omelo or the third party owner of
such trademarks, service marks, and/or logos. The Services may contain other
proprietary notices and copyright information, the terms of which you agree to
follow. Omelo may delete any information provided by you that it deems in its sole
discretion fraudulent, abusive, defamatory, obscene, or in violation of copyright,
trademark, or other intellectual property or ownership right of any other person or
entity.

Disclaimer of Warranties
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS
PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. Omelo ( pawtech
solutions private limited ) EXPRESSLY DISCLAIMS ALL WARRANTIES OF
ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING

THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
INFLECTION AI MAKES NO WARRANTY THAT (A) THE SERVICES WILL
MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE
UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE
RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES
WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY
PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL
PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL
MEET YOUR EXPECTATIONS.

19. Limitation of Liability
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY
(WHETHER IN CONTRACT, TORT, OR OTHERWISE) SHALL OMELO BE
LIABLE TO YOU OR ANY THIRD PARTY FOR (A) ANY INDIRECT,
INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE
DAMAGES, INCLUDING LOST PROFITS, LOST SALES OR BUSINESS,
LOST DATA, OR (B) FOR ANY DIRECT DAMAGES, COSTS, LOSSES OR
LIABILITIES IN EXCESS OF Rs. 8,000 (ONE HUNDRED U.S. DOLLARS).
THE PROVISIONS OF THIS SECTION ALLOCATE THE RISKS UNDER
THESE TERMS BETWEEN THE PARTIES, AND THE PARTIES HAVE
RELIED ON THESE LIMITATIONS IN DETERMINING WHETHER TO
ENTER INTO THESE TERMS.

20. No Third Party Rights
Unless explicitly stated in these Terms of Use, nothing herein is intended to confer
any enforceable rights or legal benefits on any individual or entity other than:
● You (the user),

● Omelo (Pawtech Solutions Private Limited), and

● Omelo’s affiliates, licensors, or service providers.

These Terms do not create any third-party beneficiary relationships, nor shall they
be interpreted to relieve or discharge the obligations of any third party to you or to
Omelo. No provision in these Terms grants any third party the right to bring legal
claims or assert entitlement to remedies against either you or Omelo.

Assignment
You may not assign, delegate, or transfer these Terms of Use, or any of your rights
or obligations under them, without prior written consent from Omelo.
Omelo reserves the right to freely assign, transfer, or delegate any part of this
agreement—including its rights and obligations—to:
● Any of its group companies,

● A successor in the event of a merger, acquisition, or corporate restructuring,

● Or a third-party partner as part of a service transition.

These Terms shall bind and inure to the benefit of the parties and their permitted
successors, assigns, and legal representatives.

Dispute Resolution and Arbitration Agreement

to resolve most concerns quickly and respectfully.
However, in the unlikely event we cannot resolve a dispute informally, you and
Omelo agree to the following legally binding arbitration agreement:
a. Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to:
● These Terms of Use (including interpretation, performance, or breach),

● Your access or use of Omelo’s Services or Products (App, WhatsApp,
website),

● Or any related transactions or communications,

shall be resolved exclusively through final and binding arbitration, not in court.
This arbitration shall be governed by the Indian Arbitration and Conciliation
Act, 1996, and conducted in English in Bangalore, Karnataka, before a single
neutral arbitrator mutually agreed upon by both parties.
You waive your right to a trial by judge or jury.
b. Process to Initiate Arbitration
To begin arbitration, the complaining party must send a written notice to the other
party with the following:

● Full name and contact details

Omelo will send notice to your most recent account address or registered email.
If no resolution is reached within 30 days of notice receipt, either party may
initiate arbitration.
c. Class Action Waiver
YOU AND OMELO AGREE THAT CLAIMS MUST BE BROUGHT IN AN
INDIVIDUAL CAPACITY ONLY.
Neither party may act as a representative or participate in a class, collective, or
consolidated proceeding without the written consent of both sides.
d. Exceptions to Arbitration
The following claims are not subject to arbitration:
● Intellectual property disputes (copyright, trademark, trade secrets)

● Claims eligible for resolution in small claims court

● Requests for emergency injunctive relief

e. Opt-Out Clause
You may opt out of this arbitration provision within 30 days of first accepting
these Terms by sending a written request to hello@beomelo.com. If you opt out,
you will retain the right to litigate, but Omelo will also not be bound by this
arbitration clause.
f. Governing Law
These Terms are governed by the laws of India, specifically the jurisdiction of
Karnataka. Any legal proceedings that are not subject to arbitration shall be filed
exclusively in the courts of Bangalore.

Force Majeure
We will not be deemed to be in breach of these Terms or liable for any breach of these
Terms of Use or our Privacy Policy due to any event or occurrence beyond our reasonable
control, including, without limitation, acts of God, terrorism, war, hacking, software or
hardware malfunction, cyber attacks, criminal interference, invasion, failures of any public
telecommunications or internet networks, electrical outages, earthquakes, floods,
pandemics, civil unrest, strikes, fire, or other natural or man-made disasters.

24. Indemnification
You agree to defend, indemnify, and hold harmless Omelo and its affiliates, officers,
directors, employees, agents, licensors, and partners from and against any and all claims,
liabilities, damages, losses, demands, actions, causes of action, costs, and expenses
(including reasonable legal and attorney’s fees) arising directly or indirectly from:
(i) your use or misuse of the Services or any information provided on the Omelo site, app, or
companion platform;
(ii) your violation of these Terms of Use or the Omelo Privacy Policy;
(iii) the content or subject matter of any information or data you submit to Omelo or through
the Services; and/or

(iv) any negligent or wrongful conduct by you, including but not limited to intellectual
property infringement, data privacy violations, or regulatory breaches.

Application Support; Functionality
All questions, concerns, or technical support requests relating to Omelo’s Services may be
directed to our customer support team at: support@beomelo.com. Omelo will make
commercially reasonable efforts to respond to support queries during regular business
hours, Monday through Friday, 9:00 AM to 6:00 PM IST. Please note that Omelo reserves
the right to update, change, limit, or remove functionality and features from the Services at
any time, with or without prior notice.

Modified Devices and Operating Systems
Omelo shall not be liable for any errors, performance issues, or security vulnerabilities
resulting from the use of the Services on rooted, jailbroken, or otherwise modified devices, or
on devices that are not running the operating system as released by the original equipment
manufacturer. Use of modified operating systems or devices may result in unreliable
performance and is strongly discouraged.

Revisions; General
Omelo reserves the right, at its sole discretion, to terminate or restrict your access to all or
any part of the Services, with or without cause or prior notice. Omelo also reserves the right
to revise or update these Terms of Use at any time, effective upon posting. Continued use of
the Services after such revisions constitutes your acceptance of the modified Terms. You
agree to review these Terms periodically to stay informed of changes.

If any provision of these Terms is held to be unenforceable by a court of competent
jurisdiction, such provision shall be limited to the extent necessary to maintain enforceability,
and the remaining Terms shall remain in full force.

Any legal claim or cause of action arising under these Terms must be filed within one (1)
year after the event giving rise to the claim, or be forever barred, except where a longer
limitation period is mandated by applicable law.

These Terms represent the full agreement between you and Omelo with respect to the
subject matter herein. Certain provisions may be superseded by legal notices or terms on
specific sections of the Omelo platform.

All trademarks, logos, and service marks ("Marks") displayed in the Omelo Services are
either owned by Omelo or licensed from third parties. You may not use, copy, or exploit any
such Marks without prior written consent.

Apple iOS App
If you download or access Omelo’s Services via the Apple iOS operating system, you
acknowledge and agree that:
● The iOS App may only be used on a device owned or controlled by you running iOS.

● These Terms are between you and Omelo, not Apple Inc.

● Apple has no obligation to provide maintenance or support services for the iOS App.

● In the event of any third-party claim that the App infringes intellectual property rights,
Apple will not be responsible.

● Apple is a third-party beneficiary of these Terms and has the right to enforce them
against you.

● You represent and warrant that you are not located in any embargoed country or on
any restricted party list maintained by the Government of India.
If the App fails to conform to any warranty, you may notify Apple and request a
refund of the purchase price, if applicable.

Google Play App
If you access the Omelo app via the Google Play Store (“Google-Sourced Software”), you
agree that:
● These Terms of Use are solely between you and Omelo, not Google LLC.

● Your use of the Google-Sourced Software must comply with Google’s current Play
Store Terms of Service.

● Google is not liable for support, warranty, or legal obligations regarding Omelo’s app.

● Google is a third-party beneficiary to these Terms for purposes related to the
Google-Sourced Software.


Shipping and Refund Policy
Average delivery time is 5 days.
Orders typically ship within 2–7 days, subject to destination pin code and operational conditions.
